Distance Selling Contract:

This Distance Selling Contract ("Contract") is made between SKELL YAZILIM TEKNOLOJİLERİ PAZARLAMA VE TİCARET LİMİTED ŞİRKETİ ("Service Provider") and the customer ("Customer") for the provision of services offered through the Service Provider's online platform.

1. Definitions

1.1 "Distance Selling Contract" refers to contracts where the seller and consumer are not physically present simultaneously, and the contract is formed using remote communication tools within a system established for marketing goods or services from a distance, until the moment the contract is concluded, including the moment of conclusion.

1.2 "Service Provider" refers to SKELL YAZILIM TEKNOLOJİLERİ PAZARLAMA VE TİCARET LİMİTED ŞİRKETİ, located at Turkey, Istanbul, Esenyurt 1880 Sk No: 60/1/8, with a telephone number of +90 552 850 00 30.

1.3 "Customer" refers to the individual or entity purchasing goods or services from the Service Provider through the online platform.

2. Scope

2.1 This Contract is regulated by Article 48 of the Law on Consumer Protection No. 6502 and the Distance Contracts Regulation.

2.2 The Contract applies to transactions conducted without the simultaneous physical presence of the seller and the consumer, using a system established for remote marketing.

3. Pre-Contractual Information

3.1 Before the Customer is bound by a distance contract or any corresponding offer, the Service Provider shall provide the following information clearly and comprehensively:

Essential characteristics of the goods or services.

Name, title, full address, and contact information of the Service Provider.

Total price of the goods or services, including all taxes.

Any additional costs such as delivery, handling, or other charges.

Details of the right of withdrawal, including conditions, time limit, and procedures for exercising that right.

Information on the legal remedies available to the Customer in case of disputes.

4. Conclusion of Contract

4.1 The Contract is concluded when the Customer confirms the order through the Service Provider's website, acknowledging the payment obligation.

4.2 The Service Provider must confirm the receipt of the Customer's order without undue delay and no later than when the goods are delivered or the services commence.

5. Right of Withdrawal

5.1 The Customer has the right to withdraw from this Contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day the Customer or a third party indicated by the Customer, acquires physical possession of the goods.

5.2 To exercise the right of withdrawal, the Customer must inform the Service Provider of their decision to withdraw from the Contract by an unequivocal statement (e.g., a letter sent by post, fax, or email).

5.3 The Customer may use the Model Withdrawal Form included in the Distance Contracts Regulation but is not required to do so.

6. Effects of Withdrawal

6.1 If the Customer withdraws from this Contract, the Service Provider shall reimburse all payments received from the Customer, including the costs of delivery (except for the supplementary costs arising if the Customer chose a type of delivery other than the least expensive type of standard delivery offered by the Service Provider), without undue delay and in any event not later than 14 days from the day on which the Service Provider is informed about the Customer's decision to withdraw from this Contract.

6.2 The Service Provider will carry out such reimbursement using the same means of payment as the Customer used for the initial transaction, unless the Customer has expressly agreed otherwise.

7. Delivery

7.1 Unless otherwise agreed, the Service Provider shall deliver the goods or provide the services without undue delay and no later than 30 days from the conclusion of the Contract.

7.2 If the Service Provider fails to deliver the goods within the agreed time, the Customer has the right to terminate the Contract. In such cases, the Service Provider must reimburse the Customer for all payments made.

8. Responsibilities and Obligations

8.1 The Service Provider is responsible for any loss or damage to the goods until the goods are delivered to the Customer.

8.2 The Customer must take reasonable care of the goods while in their possession and return them in good condition.

8.3 If the Customer chooses a carrier other than the one offered by the Service Provider, the risk of loss or damage to the goods passes to the Customer upon delivery to the carrier.

9. Exceptions to the Right of Withdrawal

9.1 The right of withdrawal does not apply to contracts for:

Goods made to the Customer's specifications or clearly personalized.

Goods which are liable to deteriorate or expire rapidly.

Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

Goods which are, after delivery, according to their nature, inseparably mixed with other items.

Audio or video recordings or sealed software if they were unsealed after delivery.

10. Privacy Policy

10.1 The Service Provider is committed to protecting the privacy and confidentiality of the Customer's information.

10.2 Any personal or business information provided by the Customer will be used solely for the purpose of providing and improving the services offered by the Service Provider.

10.3 The Service Provider will not share the Customer's information with third parties without the Customer's consent, except as required by law.

10.4 The Customer agrees to comply with all applicable privacy laws and regulations in the use of the Service Provider's services.

By purchasing goods or services from the Service Provider through the online platform, the Customer acknowledges and agrees to the terms and conditions of this Distance Selling Contract.
